    Yumm St. Payments allows buyers and sellers to use various forms of payments on Yumm St.com and other services. Yumm St. Payments users can pay with and accept payment by credit card, debit card, Yumm St. Credit, some bank transfer services, and PayPal. This policy explains all of your rights and obligations when using Yumm St. Payments.

    1. Accepting These Terms

    This document (the Yumm St. Payments Policy or the “Policy,” for short) sets out your rights and responsibilities when you use Yumm St. Payments on Yumm St.’s services (we’ll refer to Yumm St.com, Yumm St.Studio.com, and Yumm St.'s mobile apps and other services as our “Services”), so please read it carefully. By using Yumm St. Payments, you’re agreeing to the Policy.

    The Policy is a legally binding contract between you and Yumm St. (actually, if you transact in United States Dollars or Canadian Dollars, the contract is between you and Yumm St., Inc.; if you transact in any other currency, the contract is between you and Yumm St. Ireland UC; but we’ll just refer to Yumm St., Inc. and all of its subsidiaries collectively as “Yumm St.”).

    2. Overview

    Yumm St. Payments allows sellers to (a) accept payment by authorized credit and debit card transactions, some bank transfers services, and PayPal, (b) have those funds credited to a seller’s payment account with Yumm St., and (c) have those funds deposited into a seller’s designated bank account.

    Yumm St. Payments is only available to sellers who are at least 18 years old who register and are approved for a payment account with Yumm St. Yumm St. Payments is currently available to sellers in United States.

    Sellers may only use Yumm St. Payments for the sale of items listed on Yumm St.’s Services, and agree to ship sold items once a payment transaction is complete and reflected in their payment account. Yumm St. reserves the right to terminate a seller’s access to Yumm St. Payments if the seller uses Yumm St. Payments in any other manner.

    Buyers may authorize a payment with any major credit or debit card accepted by Yumm St., Yumm St. credits, by certain bank transfer services, or through PayPal.

    3. Third-Party Services

    Yumm St. has engaged third-party service providers to perform many of the services related to payment processing, including card processing, currency exchange, identity verification, fraud analysis and regulatory compliance.

    Yumm St. may partner with Worldpay, PayPal, Adyen, and other licensed payment processors to facilitate card payments and other payments and the disbursement of funds to sellers. The provider and processing time for your payment will vary based on the country in which you're located. If there are insufficient funds in your bank account when our provider processes the payment for your purchase, Yumm St. reserves the right to contact you directly and to seek payment.

    Yumm St. may share your personal or transactional information with those third-party service providers when it's necessary to process payments.

    By using a third-party service, you may also be subject to an agreement with the third-party. For example, PayPal is a third-party service provided by PayPal Holdings, Inc. and is subject to the PayPal User Agreement.

    If Yumm St. receives notice that your shop's content or activity violates a third party's service agreement, we may at our sole discretion take action against your account to comply with their policies. Such actions may include canceling a transaction, disabling listings from your shop, suspending your selling privileges, or removing certain payment methods.

    PayPal

    Yumm St. supports two versions of PayPal: integrated PayPal and standalone PayPal.

    Integrated PayPal. Integrated PayPal allows sellers to receive funds from PayPal purchases directly into their Yumm St. payment account, without the need to manage a separate PayPal account. This means that if a buyer pays with PayPal, the funds from the order will be credited to a seller's payment account along with the rest of the orders. The standard Yumm St. Payments Payment Processing Fee (described below) applies to orders that go through integrated PayPal; there is no additional PayPal fee.

    Standalone PayPal. For sellers accepting standalone PayPal, you will receive funds from PayPal purchases directly into your PayPal account. This payment method exists for sellers in countries that are not yet eligible for Yumm St. Payments and for sellers in certain countries who have opted to continue receiving funds into their standalone PayPal accounts. Sellers who accept standalone PayPal will continue to pay PayPal fees. Orders paid through standalone PayPal are not covered by Yumm St.’s Seller Protection Program. Please note, in certain circumstances where a seller accepts Yumm St. Payments and standalone PayPal, it may be necessary for Yumm St. to process some PayPal transactions through integrated PayPal. For example, if a buyer chooses to pay or Yumm St. Credit and covers the remaining balance using PayPal, Yumm St. can only process the transaction through integrated PayPal. Similarly, if a buyer purchases items from multiple shops in a single transaction and chooses PayPal as the payment method, Yumm St. may have to process the transaction through integrated PayPal.

    4. Yumm St.’s Rights and Responsibilities

    Yumm St. Payments functionality may be made available, modified, or discontinued by us at any time without notice and is subject to the limitations in Yumm St.’s Terms of Use. As a security measure, we may impose transaction limits on buyers and sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

    Yumm St. may refuse service of Yumm St. Payments to anyone, for any reason, at any time.

    Yumm St. reserves the right to decline transactions that we believe to be high risk, fraudulent, or in violation of Yumm St.’s Terms of Use.

    In the event that a buyer does not make payment for the purchase of a legitimate item sold using Yumm St. Payments (e.g., where the buyer used a stolen or unauthorized credit card), Yumm St. may provide limited payment protection to the seller, in the interest of fairness. Yumm St. maintains records associated with transactions on Yumm St. Payments and does not pass any secure data, including credit card numbers or bank account information to any sellers. Sellers will only receive shipping information and limited buyer account information necessary to complete the order. Yumm St.’s Privacy Policy further explains how Yumm St. handles user information.

    Yumm St. will send you any relevant notices regarding your use of Yumm St. Payments in accordance with our Electronic Communications Policy.

    5. Seller Rights and Responsibilities

    1. Use of Yumm St. Payments. If you live in a country in which Yumm St. Payments is available, you are required to sign up for Yumm St. Payments, which will result in your shop accepting payment through authorized credit and debit card transactions, some bank transfer services, and PayPal. For you to sign up for Yumm St. Payments and receive payment for transactions made through Yumm St. Payments, you must provide valid account information for a bank account in the United States. Without this information, Yumm St. cannot pay you! If you live in a country in which Yumm St. Payments is available and you do not provide Yumm St. with this information, Yumm St. may refuse you access to the Services until you do so.
    2. Payment Accounts. Yumm St. Payments is only available to sellers who register and are approved for a payment account. A payment account allows sellers to track payment amounts, refunds, and fees related to transactions. Sellers must provide accurate personal information as requested during registration, and are responsible for maintaining and updating that information as necessary. Sellers will not impersonate any person or use a name he or she is not legally authorized to use. Sellers authorize us, and authorized agents, to verify their information (including any updated information) by accessing public records and obtaining credit reports about the sellers in order to approve a payment account. Sellers also authorize Yumm St. to verify the sellers’ information from time to time while the sellers are using Yumm St. Payments. Yumm St. verifies sellers’ information in order to safeguard the integrity of the marketplace and reduce the risk of fraud, money laundering, terrorist financing, and the violation of trade sanctions.
      Payment accounts are only available to individuals who are eligible to be sellers on Yumm St.’s services and who have a valid credit or debit card on file with Yumm St., unless they are exempt from this requirement
    3. Disputes. Sellers agree to resolve any disputes directly with a buyer or with the assistance of the dispute management and refund tools available on Yumm St., and in accordance with our Seller Policy and Terms of Use. In the event that a dispute is escalated to Yumm St.’s Support Team, Yumm St. reserves the right to issue a refund to a buyer if a transaction is found to be in violation of Yumm St.’s Seller Policy and Terms of Use. In the event that a buyer submits a chargeback, Yumm St. will respond to the credit card networks on behalf of the seller involved in the transaction; the seller agrees to provide any requested information to us within five calendar days of the request. Yumm St. reserves the right to recoup funds associated with buyer chargebacks.
    4. Communications. We will inform sellers of each transaction, or of other information pertaining to Yumm St. Payments, using our standard communication procedures (detailed in our Electronic Communications Policy), including by email or through Yumm St.'s Conversations tool.
    5. Refunds. Refunds or adjustments paid by Yumm St. to buyers for payments made through Yumm St. Payments may be initiated using the refund functionality in the seller's payment account. Any such funds paid by Yumm St. to cover refunds will be deducted from the seller’s payment account balance. If there are insufficient funds to cover the amount of the refund, the balance will be charged to the seller’s credit card or added to the seller’s Yumm St. bill. Fully refunded transactions may be eligible for cancellation in accordance with the Seller Policy.
    6. International Trade Laws. You agree that your use of Yumm St. Payments will not involve any countries, entities, individuals or items prohibited by sanctions, embargoes, regulations or orders administered by the US Department of Treasury’s Office of Foreign Assets Control (“OFAC”) or other government agencies.

    6. Appointment of Yumm St. as Limited Collection Agent for Sellers

    Each seller appoints Yumm St. as its agent for the limited purpose of receiving, holding and settling payments to seller. Yumm St. will settle payments that are actually received by Yumm St. to each seller, less any amounts owed to Yumm St. and subject to these Terms. Each seller agrees that a buyer payment received by Yumm St., on behalf of seller, satisfies the buyer's obligations to make payment to seller, regardless of whether Yumm St. actually settles such payment to seller. If Yumm St. does not settle any such payments as described in these Terms to a seller, such seller will have recourse only against Yumm St. and not the buyer.

    7. Deposits

    1. Payment Account. All funds resulting from a completed transaction will be reflected as a balance in a seller’s payment account. Transactions are considered complete once the payment is approved by Yumm St. or our fraud analysis service provider. Any refunds, adjustments, or other amounts paid to buyers in connection with purchases, or for funds received since the last payment day, are also applied to the seller’s payment account balance. Funds in a payment account balance are eligible for deposit (the “Available Balance”) into a seller’s bank account at the end of any applicable deposit delay, reserve, or hold period as determined by the seller’s bank.
    2. li> Country and Currency Options. Available Balances can only be deposited into bank accounts, in the domestic currency of the account in the United States.
    3. Scheduled Deposits. Yumm St. will instruct our payments partners to initiate a deposit of a seller’s Available Balance into the seller’s bank account on a daily, weekly, biweekly, or monthly basis. Sellers can select the frequency of disbursements from their payment account in their account settings. When a seller selects daily disbursements, disbursements will be made on each day that the seller's payment account has a balance equal to or greater than the minimum daily disbursement thresholds listed below. When a seller selects weekly, biweekly, or monthly disbursements, disbursements will be made on every applicable Monday. In this policy we'll refer to the date of disbursement as the "Payment Date". Deposits into a seller’s bank account will generally be credited within three (3) to five (5) business days from the date Yumm St. initiates the deposit request. The actual timing of the deposit may depend on how quickly a seller’s bank processes the request.

    Sanctions Policy

    Yumm St. provides a direct connection between buyers and sellers around the world. When you use Yumm St.’s services (we’ll refer to Yumm St.com and other services as our “Services”), you are responsible for complying with this policy, regardless of your location.
    This policy is a part of our Terms of Use. By using any of our Services, you agree to this policy and our Terms of Use.
    As a global company based in the US with operations in other countries, Yumm St. must comply with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury. This means that Yumm St. or anyone using our Services cannot take part in transactions that involve designated people, places, or items that originate from those places, as determined by agencies like OFAC.
    This policy applies to anyone that uses our Services, regardless of their location. It is up to you to familiarize yourself with these restrictions.
    For example, these restrictions generally prohibit, but are not limited to, transactions involving:

    1. Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, and Syria, or any individual or entity operating or residing in those places;
    2. Individuals or entities identified on sanctions lists such as OFAC’s Specially Designated Nationals (“SDN”) List or Foreign Sanctions Evaders (“FSE”) List;
    3. Nationals of Cuba, regardless of location, unless citizenship or permanent residency outside of Cuba has been established; and
    4. Items originating from areas including Cuba, North Korea, Iran, or Crimea, with the exception of informational materials such as publications, films, posters, phonograph records, photographs, tapes, compact disks, and certain artworks.

    In order to protect our community and marketplace, Yumm St. takes steps to ensure compliance with sanctions programs. For example, Yumm St. prohibits members from using their accounts while in certain geographic locations. If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend or terminate your use of our Services. Members are generally not permitted to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions, since we have no way to verify when they were actually removed from the restricted location. Yumm St. reserves the right to request that sellers provide additional information, disclose an item's country of origin in a listing, or take other steps to meet compliance obligations. We may disable listings or cancel transactions that present a risk of violating this policy.
    In addition to complying with OFAC and applicable local laws, Yumm St. members should be aware that other countries may have their own trade restrictions and that certain items may not be allowed for export or import under international laws. You should consult the laws of any jurisdiction when a transaction involves international parties.

    Finally, Yumm St. members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programs. Yumm St. has no authority or control over the independent decision-making of these providers.

    The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. Below are some examples for educational purposes only. For legal advice, please consult a qualified professional. Whether you’re listing items or using community spaces on Yumm St., discrimination is not allowed. Examples of prohibited behavior on Yumm St. include, but are not limited to:

    • • Refusal of service based on membership in one or more protected group
    • • Derogatory or demeaning remarks against protected groups listed above
    • • Racial slurs
    • • Posts that support or glorify current or historical hate groups

    If you think discrimination has occurred on Yumm St., please report it by e-mailing dispute-resolution@Yumm St.com and we will investigate. If you see a listing on Yumm St. which you believe violates Yumm St.'s Prohibited Items Policy, we encourage you to flag the item by using the Report this item to Yumm St. link at the bottom of each listing page.     1. Using Community Spaces
    A community space is a public feature of Yumm St. where members can interact with one another. Members who use any of the community spaces must be over 18 years old. In addition, to make sure that Yumm St. continues to be a place that’s safe and respectful, you agree to comply with the following policies in all community spaces:

      Respect other members’ privacy. Don't share private or personally identifying information in public areas of the site, and don't spam. Be honest and transparent about who you are. Don't use a fake identity. Be respectful towards other members. Don't use community spaces to publicly disparage a specific member, shop, or item. Don't use community tools or spaces to interfere with another member’s business. Don’t use community spaces to discuss coordinating pricing with other sellers. Don't use community spaces to harass other members. Similarly, don't post content in community spaces that may promote, support, or glorify hatred. Don't publish or post threats of violence against others or promote or encourage others to engage in violence or illegal activity. Don’t engage in illegal activity or activity that infringes someone's intellectual property, or encourage others to engage in that type of activity. Yumm St. reserves the right to take action against any account or content that violates this policy.

    2. Forums
    Forums are a public space on Yumm St. where you can gather with members of our community to discuss anything you would like to talk about. Read more about Forums in this Help article. By using Yumm St.'s Forums feature, you acknowledge that:

    1. Your posts in the Forums are permanent (unless they are deleted by Yumm St. for violation of our policies).
    2. Your posts should be helpful, constructive, and encouraging when voicing dissent or criticism.
    3. Moderators may take certain actions to keep the Forums organized and helpful for everyone. Such actions are not up for public discussion.
    4. Yumm St. reserves the right to remove any inappropriate content in the Forums at any time.
    5. You may lose your Yumm St. Forums and Seller Handbook posting privileges if you violate any community policies.

    3. Teams

    You can connect with other Yumm St. members who share similar interests through Teams.

    By using Yumm St.’s Teams feature, you acknowledge that:

      Yumm St. is not responsible for or involved in a team’s membership policies, dues, finances, or any other actions. Teams that do not comply with Yumm St.'s policies may be removed, and Yumm St. reserves the right to remove a team for any reason. . Yumm St. will not mediate disputes between teams and outside parties, nor disputes between teams or team members. Yumm St. will not monitor third-party forums or other independent team sites. Any use of the term "Yumm St.," other Yumm St. Trademarks, or similar marks must comply with Yumm St.’s Trademark Policy. A team may not use mature, profane, or racist language or images in the team's name, banner, or logo. A team may not be used for the sole purpose of redirecting traffic to another web location. Yumm St. reserves the right to remove links on any profile page or team page for any reason. Unsolicited promotion or advertisement from representatives or affiliates of outside services, websites, or other products is not allowed. A team must have one captain and may additionally have one or more leaders. Team moderation is the responsibility of the Team Captain. Team forums are subject to this Community Policy and may not be used to demonstrate or discuss disputes with other members or with Yumm St. A team may have a charter detailing membership requirements and expectations for the team. Team leadership is responsible for enforcing the team's charter. A team's charter must abide by all of Yumm St.'s policies, including our Terms of Use and Intellectual Property Policy. If a team chooses to use a dedicated item listing tag (also called a “team tag”), it must contain the word "team." Yumm St. will not mediate disputes regarding use of team tags on item listings.

    4. Yumm St. Local

    Yumm St. Local connects buyers with Yumm St. sellers who are participating in fairs and markets in their area. Buyers can shop from sellers in person, supporting both the Yumm St. community and their own local economies. In order for your event to qualify for Yumm St. Local, it must be:

      • Held at a physical location • Open to the public • A limited-time engagement

    Here are some examples of events that can be promoted with Yumm St. Local:
      • Craft fairs • Markets • Special events

    The following are not eligible for Yumm St. Local:

      • Online/virtual events • Art galleries or studios (unless your event will take place in an art gallery or studio) •Brick and mortar stores (unless your event will take place in a brick and mortar store, like Small Business Saturday)

    Yumm St. Wholesale Buyer Policy

    Yumm St. Wholesale is a business-to-business platform that connects artists and designers with retail businesses. This Yumm St. Wholesale Buyer Policy explains your rights and responsibilities when using Yumm St. Wholesale. This policy is a part of our Terms of Use. By using Yumm St. Wholesale as a buyer, you’re agreeing to this policy and our Terms of Use.

    1. Qualifying for Yumm St. Wholesale
    Prospective buyers must apply and be approved by Yumm St. to purchase on the Yumm St. Wholesale marketplace. Buyers must represent retail businesses and may only make purchases on Yumm St. Wholesale to resell the purchased items. Buyers must be able to provide a valid Resale Tax ID, VAT, BN, or ABN number for your business. Buyers may only sell purchased items at the business that is represented on their application; false representation is considered a violation of our policies.
    Yumm St. reserves the right to approve or reject any application to join Yumm St. Wholesale and to refuse service to anyone, for any reason, at any time.

    3. Buyer Terms
    Buyers agree with the following terms:

    • •You guarantee that you represent a retail business and have the authority to enter into agreements on behalf of that business.
    • • When issued an invoice for an order, you agree to make payment in accordance with the seller’s policies. Non-payment or late payment may result in the suspension or termination of your account and subject you to other collection mechanisms.
    • • You agree to allow sellers and Yumm St. to contact you via phone, email, or Yumm St.’s Conversations tool (“Convos”) regarding orders you place. Not responding to inquiries from Yumm St. within seven (7) calendar days may result in the suspension or termination of your account.
    • •You acknowledge that Buyers may be featured on our Yumm St. Local platform or in other Yumm St. Wholesale promotional campaigns from time to time.

      Yumm St. operates markets where you can sell your handmade goods, vintage items, and craft supplies directly to buyers around the world. We want to make sure that you and your buyers have a positive experience on Yumm St. and Yumm St. Studio. Please read on to find out more about your rights, as well as what is expected of you, as a seller.

      This policy is a part of our Terms of Use. By opening an Yumm St. shop, you’re agreeing to this policy and our Terms of Use.

      1. What Can be Sold on Yumm St.

      Yumm St. provides unique markets. Buyers come here to purchase non-perishable and semi-perishable food items that they might not find anywhere else. Handmade items are items that are made and/or designed by you, the seller.

      If you sell handmade items, you agree that:

      1. All handmade items are made or designed by you. If you work with a production partner, you must disclose that production partner in your relevant listings.
      2. You accurately describe every person involved in the making of an item in your kitchen in your About section.
      3. You are using your own photographs -- not stock photos, artistic renderings, or photos used by other sellers or sites.
      If you are selling custom items in the Handmade category, you agree that:
      1. All custom item listings are available for purchase.
      2. Each custom listing has a set price.
      3. If you are using photographs of previous work with options for customization (like color choices) included in the listing, it is clear in your description that the photos shown are just examples.

      Food Supplies are tools, ingredients, or materials whose primary purpose is for use in the creation of an item or special occasion. We encourage you to be transparent about where and how your food supplies were made and where your materials come from.

      2. What Can't be Sold on Yumm St.

      Even if they otherwise meet our handmade, prohibited items, services, and items that violate our intellectual property policies are not allowed to be sold on Yumm St. Reselling is not allowed on Yumm St. Reselling refers to listing an item as handmade when you were not involved in designing or making that item. Keep in mind that members may flag listings that appear to violate our policies for Yumm St.'s review. Yumm St. may remove any listings that violate our policies. Note that listing fees are non-refundable. Yumm St. may also suspend or terminate your account for any violations. You’ll still be on the hook to pay any outstanding fees on your Yumm St. bill. You can find more information in our Fees & Payments Policy.

      If you are raising money on behalf of a charity, you must obtain that charity’s consent.

      3. Representing Yourself, Your Shop, and Your Listings Honestly

      At Yumm St., we value transparency. Transparency means that you honestly and accurately represent yourself, your items, and your business.

      By selling on Yumm St., you agree that you will:

      1. Provide honest, accurate information in your About section.
      2. Honor your Shop Policies.
      3. Accurately represent your items in listings and listing photos.
      4. Respect the intellectual property of others. If you feel someone has violated your intellectual property rights, you can report it to Yumm St.
      5. Not engage in fee avoidance.
      6. Not create duplicate shops. Please see Multiple Shops on Yumm St. for more details.
      7. Not coordinate pricing with other sellers.

      4. Privacy and Communicating with Other Yumm St. Members

      Conversations

      You can use Yumm St. Conversations (“Convos”) to communicate directly with your buyers or other Yumm St. members. Conversations are a great way for buyers to ask you questions about an item or an order.

      Conversations may not be used for the following activities:

      1. Sending unsolicited advertising or promotions, requests for donations, or spam;
      2. Harassing or abusing another member or violating our Anti-Discrimination Policy;
      3. Contacting someone after they have explicitly asked you not to; or
      4. Interfering with a transaction or the business of another member.

      Interference

      Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on Yumm St. Examples of interference include:

    • Contacting another member via Yumm St. Conversations to warn them away from a particular member, shop, or item;
    • Posting in public areas to demonstrate or discuss a dispute with another member;
    • Purchasing from a seller for the sole purpose of leaving a negative review;
    • Maliciously clicking on a competitor's Promoted Listings ads in order to drain that member's advertising budget, also known as "click fraud."

      Privacy and Protecting Personal Information

      You are responsible for protecting members’ personal information you receive or process. This means that, to the extent you use the Services outside of the Sites or Apps, or to the extent your local jurisdiction requires it, you must maintain a privacy policy for your shop that is consistent with the privacy terms set forth in Yumm St.’s Terms of Use (including this Seller Policy) and Yumm St.’s Privacy Policy. Such laws may require that you post, and comply with, your own privacy policy, which must be accessible to Yumm St. members you interact with and compatible with this policy and Yumm St.’s Terms of Use.

      When you sell on Yumm St., you may communicate with other members or have transactions with buyers. This means you may process personal information (for example, buyer name, email address, and shipping address) and may be considered an independent and separate “data controller” under EU law or other local regulations. If you disclose personal information like a buyer’s name and email address without the buyer’s consent, you are responsible for that unauthorized disclosure.

      For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Yumm St.-related communications or for Yumm St.-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s consent, and subject to other applicable Yumm St. policies and laws, you may not add any Yumm St. member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance.

      If Yumm St. and you are found to be joint data controllers of personal information, and if Yumm St. is sued, fined, or otherwise incurs expenses because of something that you did as a joint data controller of buyer personal information, you agree to indemnify Yumm St. for the expenses it occurs in connection with your processing of buyer personal information.

      5. Creating and Uploading Content

      As a member of Yumm St., you have the opportunity to create and upload a variety of content, like listings, Convos, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

      1. Abusive, threatening, defamatory, harassing, or otherwise in violation of our Anti-Discrimination Policy;
      2. Obscene or vulgar;
      3. In violation of someone else’s privacy or intellectual property rights; or
      4. . False, deceptive, or misleading.

      6. Building a Positive Reputation Through our Reviews System

      Reviews are a great way for you to build a reputation on Yumm St. Buyers can leave a review, including a one to five star rating and a photograph of their purchase, within 100 days after their item’s expected delivery date. The estimated delivery date is the purchase date + processing time + shipping time. Buyers can edit their review, including the photograph, any number of times during that 100 day period.

      On the rare occasion you receive an unfavorable review, you can reach out to the buyer or, if the review is less than 3 stars, leave a response.

      Reviews and your response to reviews may not:

      1. Contain private information;
      2. Contain obscene, racist, or harassing language or imagery;
      3. . Violate our Anti-Discrimination Policy;
      4. Contain prohibited medical drug claims;
      5. Contain advertising or spam;
      6. Be about things outside the seller’s control, such as a shipping carrier, Yumm St. or a third party; or
      7. Undermine the integrity of the Reviews system.

      Extortion

      Extortion is not allowed on Yumm St. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on Yumm St. Extortion includes when a seller offers a buyer additional goods, services, or compensation in exchange for a positive review.

      Shilling

      Shilling is strictly prohibited on Yumm St. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.

      7. Customer Service

      We expect our sellers to provide a high level of customer service. By selling on Yumm St., you agree to:

      1. Honor your shipping and processing times. Sellers are obligated to ship an item or otherwise complete a transaction with a buyer in a prompt manner, unless there is an exceptional circumstance. Please be aware that legal requirements for shipping times vary by country. These requirements are detailed in our Shipping Policy.
      2. Respond to Conversations in a timely manner.
      3. Honor the commitments you make in your shop policies.
      4. Resolve disagreements or disputes directly with the buyer. In the unlikely event that you can’t reach a resolution, our Dispute Resolution team can help through our case system.
      5. . If you are unable to complete an order, you must notify the buyer and cancel the order. Yumm St. will help you provide great customer service and maintain trust with your buyers through our Seller Service Level Standards (“SLS.”)
      6. Yumm St. also provides limited protection to sellers who meet the requirements of our Seller Protection Program.

      8. Responding to Requests for Cancellations, Returns, and Exchanges

      Please be aware that in addition to this policy, each country has its own laws surrounding shipping, cancellations, returns, and exchanges. Please familiarize yourself with the laws of your own country and those of your buyers’ countries.

      Cancellations

      If you are unable to complete a transaction, you must notify the buyer via Yumm St. Conversations and cancel the transaction. If the buyer already submitted payment, you must issue a full refund. You are encouraged to keep proof of any refunds in the event a dispute arises.

      You may cancel a transaction under the following circumstances:

      1. The buyer did not pay. (The seller may flag a buyer for a payment not received, chargeback, or canceled payment.)
      2. Both you and the buyer agree to cancel the transaction prior to shipment, and you have issued the buyer a full refund.
      3. You have decided to refuse service to the buyer and are complying with our Anti-Discrimination Policy. If the buyer has already paid, you must also issue a full refund, including shipping.
      4. . The buyer did not receive the item(s) ordered, even though you provided proof of shipping, and you have issued a refund for the item. (Refunding shipping is optional, unless the buyer paid with Yumm St. Payments, in which case you'll need to refund in full.)
      5. Both you and the buyer agreed that the buyer could return the item for a refund, you have received the returned item and issued a refund to the buyer for the item. (Refunding shipping is optional, unless the buyer paid with Yumm St. Payments, in which case you will need to refund in full.)

      Yumm St.’s Case System

      We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before opening a case on Yumm St. For this reason, it is important that you fill out your shop policies and regularly respond to Conversations from your buyers.

      Buyers may file a case for a non-delivery or a not-as-described item. You must respond to any open cases within seven days or the time frame noted by Yumm St. in the case. Yumm St. reserves the right to escalate a case early for circumstances such as seller inactivity, harassment, refusal of service, case manipulation, and undermining the integrity of the case system.

      By using Yumm St.’s Case System, you understand that under Yumm St.’s dispute resolution procedures, Yumm St. may use your personal information for the purpose of resolving disputes with other members. Cases can be filed in the following circumstances:

      Non-Delivery

      A non-delivery occurs when a buyer places an order and submits payment, but does not receive the item. The following are examples of non-delivery cases:

      1. An item was never sent.
      2. An item was not sent to the address provided on Yumm St.
      3. There is no proof that the item was shipped to the buyer’s address.

      Not as Described

      An item is not as described if it is materially different from your listing description or your photos. The following are examples of not as described cases:

      1. The item received is a different color, model, version, or size than is shown in the photo or described in the listing.
      2. The item has a different design or material.
      3. The item was advertised as authentic but is not authentic.
      4. You failed to disclose the fact that an item is damaged or is missing parts.
      5. A buyer purchased three items but only received two.
      6. . The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.

      Not as Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:

      1. The item(s) were ordered for a specific date or event.
      2. The item(s) are rendered useless after that date.
      3. The seller did not ship the item(s) according to their processing time or the date agreed upon in Conversations.

      If Yumm St. determines that an item is not as described, you will be required to refund the original shipping and return shipping, in addition to the cost of the item.

      Ineligible Transactions

      Some disputes don’t qualify for Yumm St.’s case system. These include:

      1. Items that have been purchased in person.
      2. Intangible items, services, or prohibited items.
      3. Transactions where payment is not made through Yumm St. Payments or PayPal.
      4. Items that are returned without a return agreement.
      5. Items that have been altered, used, worn, or washed after receiving them.
      6. Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer.
      7. Items that are received after the agreed-upon delivery date due to shipping delays.
      8. Cost of shipping disputes.

      When a dispute is ineligible for our case system, we encourage both parties to work together to come to an amicable solution.

      Advertising & Marketing Policy

      We believe ads should help sellers grow their businesses and contribute to the overall member experience. Yumm St. offers sellers multiple advertising channels to promote their listings. This Advertising & Marketing Policy explains your rights and responsibilities when using Yumm St.'s advertising services.

      This policy is a part of our Terms of Use. By using any of Yumm St.'s advertising services, you're agreeing to this policy and our Terms of Use.

      Sellers currently can purchase two types of paid advertising through Yumm St.'s Advertising Dashboard: Promoted Listings and Google Shopping ads.

      Promoted Listings display a seller's items prominently on Yumm St.'s websites and mobile apps. Promoted Listings are displayed in users' search results, based on search relevancy, listing quality, and the amount bid to display the listing. You can choose to promote some or all of your listings as Promoted Listings.

      Google Shopping ads display a seller's listings directly in Google search results and through the Google Shopping service based on search relevancy, listing quality, and the amount bid to display the listing. You can choose to promote some or all of your listings through Google Shopping ads. By purchasing Google Shopping ads, you agree to comply with Google's policies, including Google Shopping policies and AdWords Terms and Conditions. Violation of these policies may result in the suspension or termination of your Google Shopping campaign.

      A. Purchasing Paid Advertising

      Ad fees are charged on a cost-per-click (or "CPC") basis, and you are responsible for paying for any clicks your ad receives. This means that you will be charged only when your ad is clicked, not simply when it is displayed. You may pause an ad campaign at any time, but you will still be responsible for any charges incurred prior to pausing your campaign. Sorry, but Yumm St. is not able to grant refunds for any charges related to clicked ads.

      Your ad fees will appear on your Yumm St. bill on a daily basis, along with other charges, such as listing fees. You can learn more about your Yumm St. bill in our Fees & Payments Policy.

      B. Promoted Listings

      Yumm St.'s Promoted Listings use a sealed bid generalized second-price auction system to determine the cost and placement of ads. In other words, ad inventory is "auctioned off" at varying prices, depending on the demand. For example, if more Promoted Listings qualify for a particular search query, the auction price may also increase.

      To purchase Promoted Listings, you must enter a "bid." A bid is the maximum amount of money you are willing to pay if a buyer clicks on your Promoted Listing. Actual costs incurred will vary depending on the number of participants in the auction and their bid amounts. By entering a bid, you agree to pay any amount up to and including the bid amount for a click on your ad. All bids must be made in United States dollars (USD).

      For each Promoted Listing, you can manage your bidding manually or allow Yumm St.'s bid management system to automatically optimize your bid selection ("auto-bidding"). You may change your selection at any time. Auto-bidding is designed to determine the optimal bid price that will deliver as many clicks as possible for a Promoted Listing within a given budget. By utilizing auto-bidding, you understand and acknowledge that your bids may change at any time. You may, however, set a "max-CPC" or maximum bid for your listings, in which case the auto-bidding system will never place a bid higher than your max-CPC.

      You may also choose to use Yumm St.'s Auto Promote feature, which allows you to automatically promote new listings as you add them to your shop. By using the Auto Promote feature, you understand and acknowledge that you will be enabling auto-bidding for each new listing.

      You can set a budget to limit the amount you're willing to pay Yumm St. to promote your listings. Your daily budget can be as low as $1, and you will never be charged more than your daily budget.

      C. Google Shopping

      Yumm St.'s Advertising Dashboard allows you to purchase Google Shopping ads directly from your Yumm St. account. Google's advertising system uses an auction to determine cost and placement of ads, so the cost may vary based on time of day, demand, and availability.

      To purchase Google Shopping ads, you must enter an average daily budget, which must be at least $1 and set in USD. Please note that Google manages campaigns to optimize results on a monthly rather than a daily basis. That means that Google may exceed your average daily budget by up to 100% on any given day. However, if you maintain the same average daily budget for a month, you won’t be charged more than your average daily budget multiplied by the average number of days in a month (30.4).

      During your campaign, all of your listings will be promoted by default, including any new listings you create. You can remove listings from your campaign at any time from your Advertising Dashboard. If you make any edits to your Yumm St. listings during your campaign, your ads will be updated automatically to reflect those changes.

      By purchasing Google Shopping ads, you’re opting out of Yumm St.'s free Google Shopping Engine Ads. If you pause or end your Google Shopping ads campaign, you'll automatically be re-enrolled in our free Shopping Engine Ads.

      2. Shopping Engine Ads

      Yumm St. allows you to promote your listings on third-party shopping engines – we call them Shopping Engine Ads. By enabling Shopping Engine Ads in your account, you grant us permission to promote your listings on third-party sites to show your products to potential buyers who may not be searching on Yumm St. You may opt out of the Shopping Engine Ads program at any time by disabling the feature in your Shop settings.

      Participation in the Shopping Engine Ads is currently free for sellers. That means that while shopping engines do charge a fee to list products, Yumm St. is currently paying these fees. Yumm St. reserves the right to change the terms of this program at any time, but we will, of course, notify you of any changes.

      Shopping Engine Ads are subject to the terms and policies set forth by each participating shopping engine, which may be different from Yumm St.'s. You are responsible for complying with the terms and policies of the participating third party sites. By failing to do so, your Shopping Engine Ad may be removed, and you may be prohibited from participating in the Shopping Engine Ad program.

      3. Advertising Disclaimers

      Here are a few things we have to say, just so we're clear.

      Using advertising services through Yumm St. does not constitute an obligation on Yumm St.'s part to display an ad or promote your listings. Yumm St. can't guarantee that a displayed ad will be clicked, and we can't guarantee that if a user clicks on an ad, the related listing will be sold.

      Ads may not include content that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights. Please see our Intellectual Property Policy for more information. You are responsible for ensuring that your ads comply with all applicable laws and regulations.

      We hate to do it, but Yumm St. reserves the right to reject or remove any ad for any reason, in our sole discretion, including ads that negatively affect our relationships with our members or partners.

      4. Shop-Specific Promotions

      Sellers on Yumm St. may choose to offer promotions specifically for their own shops. Yumm St. currently offers two promotional tools: Sales and Coupons.

      A Sale is a promotion that offers free shipping or discounts your listing price by a percentage. You can run a sale on a single listing or on multiple listings. Sales are public and will be displayed to all buyers. On occasion, Yumm St. may aggregate Sales and promote them through our websites, apps, and emails.

      A Coupon is a code that may be redeemed for a discount on an item or free shipping. Coupons are not displayed publicly; as a seller, you may create and distribute Coupons at your discretion. Please note, however, that a Coupon code can be used by any buyer that redeems the code and that a buyer can use a Coupon code on multiple listings and on multiple occasions. You also have the option to automatically send a Coupon as a thank you to your buyers if they are opted in to Yumm St.’s emails.

      Sellers are responsible for following Yumm St.'s policies and all applicable laws associated with Sales and Coupons. For Sales, it's your responsibility to set the terms and conditions for the promotion in the "Sale details" section. For Coupons, it's your responsibility to communicate any terms or limitations for the promotion to buyers when sharing the Coupon code. Sales and Coupons may not be used for fee avoidance, such as lowering your item price while artificially inflating your shipping price.

      1. Using Community Spaces

      A community space is a public feature of Yumm St. where members can interact with one another. Members who use any of the community spaces must be over 18 years old. In addition, to make sure that Yumm St. continues to be a place that’s safe and respectful, you agree to comply with the following policies in all community spaces:

      1. Respect other members’ privacy. Don't share private or personally identifying information in public areas of the site, and don't spam.
      2. Be honest and transparent about who you are. Don't use a fake identity.
      3. Be respectful towards other members. Don't use community spaces to publicly disparage a specific member, shop, or item.
      4. Don't use community tools or spaces to interfere with another member’s business.
      5. Don’t use community spaces to discuss coordinating pricing with other sellers.
      6. Don't use community spaces to harass other members. Similarly, don't post content in community spaces that may promote, support, or glorify hatred.
      7. Don't publish or post threats of violence against others or promote or encourage others to engage in violence or illegal activity.
      8. Don’t engage in illegal activity or activity that infringes someone's intellectual property or encourage others to engage in that type of activity.

      Yumm St. reserves the right to take action against any account or content that violates this policy.

      Forums are a public space on Yumm St. where you can gather with members of our community to discuss anything you would like to talk about.

      By using Yumm St.'s Forums feature, you acknowledge that:

    • Your posts in the Forums are permanent (unless they are deleted by Yumm St. for violation of our policies).
    • Your posts should be helpful, constructive, and encouraging when voicing dissent or criticism.
    • Moderators may take certain actions to keep the Forums organized and helpful for everyone. Such actions are not up for public discussion.
    • Yumm St. reserves the right to remove any inappropriate content in the Forums at any time.
    • You may lose your Yumm St. Forums and Seller Handbook posting privileges if you violate any community policies.

      You can connect with other Yumm St. members who share similar interests through Teams.

      By using Yumm St.’s Teams feature, you acknowledge that:

    • Yumm St. is not responsible for or involved in a team’s membership policies, dues, finances, or any other actions.
    • Teams that do not comply with Yumm St.'s policies may be removed, and Yumm St. reserves the right to remove a team for any reason.
    • Yumm St. will not mediate disputes between teams and outside parties, nor disputes between teams or team members.
    • Yumm St. will not monitor third-party forums or other independent team sites.
    • Any use of the term "Yumm St.," other Yumm St. Trademarks, or similar marks must comply with Yumm St.’s Trademark Policy.
    • A team may not use mature, profane, or racist language or images in the team's name, banner, or logo.
    • A team may not be used for the sole purpose of redirecting traffic to another web location. Yumm St. reserves the right to remove links on any profile page or team page for any reason. Unsolicited promotion or advertisement from representatives or affiliates of outside services, websites, or other products is not allowed.
    • A team must have one captain and may additionally have one or more leaders. Team moderation is the responsibility of the Team Captain.
    • Team forums are subject to this Community Policy and may not be used to demonstrate or discuss disputes with other members or with Yumm St.
    • A team may have a charter detailing membership requirements and expectations for the team. Team leadership is responsible for enforcing the team's charter. A team's charter must abide by all of Yumm St.'s policies, including our Terms of Use and Intellectual Property Policy.
    • If a team chooses to use a dedicated item listing tag (also called a “team tag”), it must contain the word "team." Yumm St. will not mediate disputes regarding use of team tags on item listings.

      4. Yumm St. Local

      Yumm St. Local connects buyers with Yumm St. sellers who are participating in fairs and markets in their area. Buyers can shop from sellers in person, supporting both the Yumm St. community and their own local economies.

      In order for your event to qualify for Yumm St. Local, it must be:

      • • Held at a physical location
      • • Open to the public
      • • A limited-time engagement

      Here are some examples of events that can be promoted with Yumm St. Local:

      The following are not eligible for Yumm St. Local:

    Yumm St. reserves the right to approve or reject any application to join Yumm St. Wholesale and to refuse service to anyone, for any reason, at any time.

    3. Seller Terms

    Sellers agree with the following terms:

    • • Fees: Sales made through Yumm St. Wholesale will incur a 3.5% transaction fee (excluding taxes and shipping costs) paid to Yumm St. You may also incur a payment processing fee if a buyer pays with a credit or debit card. Transaction and processing fees will be added to your Yumm St. bill.
    • • Pricing: Yumm St. maintains a minimum margin requirement to meet industry standards and the expectations of our retailer community.
      • •You agree that the wholesale price of your items will be at least 50% less than the retail price; and
      • • You agree that the MSRP (Manufacturer’s Suggested Retail Price) of your items will match the existing retail price.
    • •You agree to accurately and faithfully update the status of orders through the Yumm St. Wholesale purchase order system (for example, as “Approved,” “Shipped,” or “Paid”). Failure to do so is considered fee avoidance and may result in the suspension or termination of your account and subject you to other collection mechanisms.
    • •You agree not to use Yumm St.’s features or tools to direct transactions off Yumm St. Wholesale, or to circumvent or manipulate our fee structure, the billing process, or fees owed to Yumm St. in any way.
    • • All purchase orders initiated through Yumm St. Wholesale must remain on Yumm St. Wholesale.
    • • You agree to allow buyers and Yumm St. to contact you via phone, email, or Yumm St.’s Conversations tool (“Convos”) regarding orders you receive. Not responding to inquiries from Yumm St. within seven (7) calendar days may result in the suspension or termination of your account.
    • • You agree only to sell items on Yumm St. Wholesale that comply with Yumm St.’s Seller Policy for the handmade category (vintage goods and craft supplies may not be sold on Yumm St. Wholesale) and Yumm St.’s Intellectual Property Policy.
    • •You are solely responsible for collecting and remitting any and all taxes applicable to any sales you make on Yumm St. Wholesale and for requesting and inspecting any documents required for taxes or tax exemptions from Buyers.

    Intellectual Policy

    Yumm St. adopted this intellectual property policy in accordance with industry best practices, general U.S. intellectual property laws, and the Digital Millennium Copyright Act.

    Notices of Intellectual Property Infringement

    Yumm St. strives to respond quickly when we receive proper notice of intellectual property infringement by removing or disabling access to the allegedly infringing material. When Yumm St. removes or disables access in response to a notice, Yumm St. makes a reasonable attempt to contact the allegedly infringing party, provide information about the notice and removal, and, in cases of alleged copyright infringement, provide information about counter notification. Yumm St. may also provide a copy of the notice to the allegedly infringing party.

    Counter Notification

    If Yumm St. receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Yumm St. of this action. Yumm St. sends a copy of the counter notice to the original complaining party.

    Repeat Infringement

    Yumm St. terminates account privileges of members that are subject to repeat notices of intellectual property infringement in appropriate circumstances and at Yumm St.’s discretion.

    Pattern Policy

    Pattern by Yumm St. allows you to grow your brand by creating a standalone website that will appear outside the Yumm St. marketplace. This Pattern Policy explains how the tool works and the rules you need to know to be successful.

    This policy is a part of our Terms of Use. By using Pattern, you're agreeing to this policy and our Terms of Use.

    1. Eligibility

    You can create a Pattern site if you're an existing Yumm St. seller and you're registered to use Yumm St. Payments. You can turn Pattern on or off in the Pattern section of your Yumm St. Shop settings.

    2. Fees

    Subscription Fees

    You're welcome to try Pattern for free for 30 days. Your free trial will begin when you select "Start Free Trial" from the Pattern dashboard. After 30 days, you can continue to use Pattern at the monthly subscription fee of $15.00 USD. Your first month's bill will be prorated, based on when you signed up, and you'll be charged the full subscription fee for each subsequent month you use Pattern. Your subscription fees will appear on your Yumm St. bill.

    Other Fees

    Transaction fees for sales in Pattern work the same way they do for sales through your Yumm St. shop. When you make a sale through your Pattern site, you will be charged a transaction fee of 3.5% of the item price. This percentage does not apply to the shipping cost or tax. Transaction fees will appear on your Yumm St. bill. You will also be responsible for a payment processing fee when a buyer pays through Yumm St. Payments. You can choose whether a listing appears only on your Pattern site or on both your Pattern site and your Yumm St. shop. Pattern-only listings (that is, listings that you only make available on your Pattern site) do not incur a listing fee and never expire. You can choose to make a Pattern-only listing available in your Yumm St. shop at any time. When you list an item on both your Pattern site and your Yumm St. shop, you’ll be responsible for Yumm St.’s regular listing fee, and your listing will expire after four months.

    Your domain name has to comply with our Terms of Use (so it can't be offensive or infringe on someone's intellectual property rights) and our Trademark Policy (so it may not use any trademarks owned by Yumm St. without our permission). We can't guarantee the availability of any particular domain name. If your domain name is the subject of a legal action, you agree to indemnify and release Yumm St. from any liability.

    3. Your Pattern Content

    When you set up your Pattern site, your content – including your shop images, About section, Shop Policies, and listings – will be populated automatically from your existing Yumm St. shop and profile. You’ll have the opportunity to customize some Pattern content to match your unique branding.

    You have the option of listing your items for sale just on your Pattern site or on both Pattern and Yumm St. All listings, including Pattern-only listings, must comply with our Prohibited Items Policy. Items listed on both Pattern and Yumm St. must also meet the marketplace criteria outlined in Yumm St.’s Seller Policy.

    You understand that you're solely responsible for your content. You represent that you have all necessary rights to your content and that you're not infringing or violating any third party's rights by posting it. You also understand that you're solely responsible for any content uploaded by visitors to your Pattern site and for removing such content from your Pattern site to the extent required by our policies or the law.

    By posting your content to your Pattern site, you grant Yumm St. a license to use it. This license is just like the one you grant to Yumm St. when you post content to your Yumm St. shop. For a detailed description of the rights you're granting to Yumm St. and what we can do with your content, please see Section 5 of our Terms of Use. Rest assured, we don't claim any ownership of your content; we just have your permission to display it and use it in different ways that help us promote your business and Yumm St.'s.

    4. Checkout

    When a buyer purchases an item from your Pattern site, they'll be directed to a checkout page on Yumm St.'s site that will highlight the name of your Pattern site. Buyers can complete the transaction by signing into their Yumm St. account, registering a new Yumm St. account, or proceeding without an Yumm St. account through Guest Checkout.

    5. Legal

    You are solely responsible for posting and complying with your own shop policies. We encourage you to use the shop policy tools offered by Yumm St. to provide clear information to your buyers.

    You are also solely responsible for complying with any legal requirements that you may be subject to and you agree to release Yumm St. from any liability related to your use of Pattern and any domains associated with your Pattern site. If you receive a notice involving intellectual property infringement through your Pattern site, it is your responsibility to respond in accordance with the law. If Yumm St. receives a notice involving intellectual property infringement for content on your Pattern site, we will act in accordance with our Intellectual Property Policy.

    We reserve the right to remove any content from your Pattern site or to prevent you from using Pattern entirely, if your site violates any of Yumm St.'s policies or if we're required to do so for legal reasons.

    Sanctions Policy

    Yumm St. provides a direct connection between buyers and sellers around the country. When you use Yumm St.’s services (we’ll refer to Yumm St.com and other services as our “Services”), you are responsible for complying with this policy, regardless of your location.

    This policy is a part of our Terms of Use. By using any of our Services, you agree to this policy and our Terms of Use.

    As a global company based in the US with operations in other countries, Yumm St. must comply with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury. This means that Yumm St. or anyone using our Services cannot take part in transactions that involve designated people, places, or items that originate from those places, as determined by agencies like OFAC.

    This policy applies to anyone that uses our Services, regardless of their location. It is up to you to familiarize yourself with these restrictions.

    For example, these restrictions generally prohibit, but are not limited to, transactions involving:

    1. Certain geographic areas, such as Crimea, Cuba, Iran, North Korea, and Syria, or any individual or entity operating or residing in those places;
    2. Individuals or entities identified on sanctions lists such as OFAC’s Specially Designated Nationals (“SDN”) List or Foreign Sanctions Evaders (“FSE”) List;
    3. Nationals of Cuba, regardless of location, unless citizenship or permanent residency outside of Cuba has been established; and
    4. Items originating from areas including Cuba, North Korea, Iran, or Crimea, with the exception of informational materials such as publications, films, posters, phonograph records, photographs, tapes, compact disks, and certain artworks.

    In order to protect our community and marketplace, Yumm St. takes steps to ensure compliance with sanctions programs. For example, Yumm St. prohibits members from using their accounts while in certain geographic locations. If we have reason to believe you are operating your account from a sanctioned location, such as any of the places listed above, or are otherwise in violation of any economic sanction or trade restriction, we may suspend or terminate your use of our Services. Members are generally not permitted to list, buy, or sell items that originate from sanctioned areas. This includes items that pre-date sanctions, since we have no way to verify when they were actually removed from the restricted location. Yumm St. reserves the right to request that sellers provide additional information, disclose an item's country of origin in a listing, or take other steps to meet compliance obligations. We may disable listings or cancel transactions that present a risk of violating this policy.

    In addition to complying with OFAC and applicable local laws, Yumm St. members should be aware that other countries may have their own trade restrictions and that certain items may not be allowed for export or import under international laws. You should consult the laws of any jurisdiction when a transaction involves international parties.

    Finally, Yumm St. members should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block transactions as part of their own compliance programs. Yumm St. has no authority or control over the independent decision-making of these providers.

    The economic sanctions and trade restrictions that apply to your use of the Services are subject to change, so members should check sanctions resources regularly. Below are some examples for educational purposes only. For legal advice, please consult a qualified professional.

    Seller Protection Policy

    Yumm St.'s Seller Protection can offer a little extra peace of mind to eligible sellers. When you qualify, Yumm St. will work with you to resolve cases, investigate chargebacks, and help you deal with any other issues that come up with your Yumm St. or Yumm St. Studio shop. This Seller Protection Policy explains the steps you must take to be eligible for Seller Protection and the types of items and transactions that may be covered.

    1. Seller Eligibility Requirements

    Eligible sellers are automatically enrolled in Seller Protection -- there is no application process. Here's what you need to do to make sure your shop is covered:

    1. Keep your shop in good standing (that means you're not violating any of Yumm St.'s policies). The requirements may be found at FDA Resources for You
    2. Seller must adhere to all requirements of the Food and Drug Administration regarding preparation, labeling and kitchen registration in order to sell food across state lines.
    3. Enroll in Yumm St.'s payment platform, Yumm St. Payments.
    4. Fill out all of your Shop Policies (it's especially important to have policies for returns, exchanges, and custom orders). This should go without saying, but your Shop Policies have to comply with Yumm St.'s policies, as well as your local laws.
    5. Use accurate photographs and descriptions when you list items. Nobody likes buying one thing and receiving something else!
    6. . Include reasonable and accurate processing times or ship-by dates (because getting a birthday gift a week late isn't great).
    7. Cooperate with investigations conducted by Yumm St. Promptly provide any information requested by Yumm St., and cancel and refund any transactions deemed invalid or unauthorized by Yumm St.

    Seller Protection

    2. Order Eligibility Requirements

    Follow these steps to make sure your orders are covered by Yumm St.'s Seller Protection:

    1. Ship your order according to the processing time or ship-by date you listed or as agreed upon through Yumm St. Conversations.
    2. Ship the order to the address provided on Yumm St. or Yumm St. Studio. If your buyer provides an alternate shipping address through Conversations, be mindful of fraud or scams. You may choose to cancel and refund the order and ask the buyer to purchase the item again with the corrected shipping address.
    3. Mark the order as shipped after you send it out. If you use Yumm St. Shipping Labels, the order will automatically be marked as shipped (if you don't use Yumm St. Shipping Labels, give them a try… they make shipping a snap!).
    4. Provide valid proof of shipping. Valid proof can include a shipping or tracking number that shows the order route and delivery progress.
    5. Use Yumm St. Payments to receive payment for the order.

    3. Items and Transactions Not Eligible

    While most items and transactions qualify for Seller Protection, there are a few exceptions:

    1. Items sold in person via the Sell on Yumm St. app.
    2. Subscriptions or other transactions in which the buyer submits a single payment for recurring deliveries (like item-of-the-month clubs).
    3. Transactions processed outside of Yumm St. Payments, for example, through standalone PayPal or a personal check.
    4. Any order or transaction that is fulfilled by the seller despite notice from Yumm St. admin that the order or transaction in question is invalid, fraudulent, or under investigation.

    4. Seller Protection Benefits

    If your shop and the order in question satisfy the eligibility requirements, Yumm St. will try to help you resolve Non-Delivery cases, Not as Described cases, and chargebacks. We may have to request additional information from you. For Non-Delivery or Not as Described cases, we'll need you to respond to our inquiries within 7 calendar days or the time frame noted by Yumm St. in the case. If a chargeback is filed against you, we'll need you to respond to any inquiries from Yumm St. as soon as possible, and no later than 5 calendar days. If you don't give us the necessary information in time, we may not be able to help resolve the dispute. Please keep in mind that we can't guarantee a resolution in your favor.

    Shipping Policy

    Yumm St. offers a variety of services to make it easier for sellers to get their one-of-a-kind items into the hands of buyers quickly and securely. This Shipping Policy explains your shipping obligations as a seller and your rights and responsibilities when using Yumm St.’s shipping labels services.

    1. Shipping Your Items

    Sellers are responsible for shipping their sold items to buyers. If you're using a shipping or fulfillment service, please keep in mind that you are ultimately responsible for making sure that your buyers receive the item(s) they purchased from your shop.

    By selling on Yumm St., you agree to:

    1. Provide an accurate "ships from" address.
    2. Specify your shipping costs and processing times in your listings.
    3. Ship items promptly after they are sold. Prompt shipping means that you ship each item within 30 days of purchase, unless you specify otherwise in your processing time or agree to a different shipping period with the buyer through Conversations.
    4. Comply with all local and international shipping and customs regulations. We know that shipping and customs regulations can be tough to read, so check out these Help articles on international shipping using United States Postal Service (USPS).
    5. . Shipping to the wrong address is likely to result in a non-delivery case, so make sure to ship to the address listed on Yumm St.
    6. Mark the order as shipped when you ship it, or use an Yumm St. Shipping Label, which automatically marks your order as shipped. Remember that you may only mark an order as shipped after you actually have shipped it.
    7. When you mark an order as shipped, the buyer will receive a notification (and may even break out into their happy dance).
    8. Charge an appropriate amount for shipping. US sellers can use calculated shipping to have shipping costs calculated automatically. By entering tracking information on Yumm St., you're giving us permission to collect and share the tracking information received from your chosen shipping carrier with the buyer.

    In the unlikely event an order does not arrive, be prepared to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided on Yumm St. or Yumm St. Studio. If a buyer does not receive their order, they may file a case against your shop.

    But don't fret, Yumm St. offers protection to sellers who meet our Seller Protection Program requirements.

    2. Yumm St. Shipping Labels

    Sellers in the United States and Canada who accept Yumm St. Payments or PayPal as a payment method are able to use Yumm St. Shipping Labels.

    By using Yumm St. Shipping Labels, you confirm that:

    1. All shipping labels will only be used to ship corresponding Yumm St. orders.
    2. Shipping labels may not be transferred or sold to a third party.
    3. Each shop has a designated bill limit for creating shipping labels, which is based on recent bill history. If you reach your bill limit, you must pay your bill before you can create another label. Read more about our bills in our Fees & Payments Policy.
    4. Yumm St. reserves the right to remove your access to Yumm St. Shipping Labels at any time and for any reason.

    USPS Labels

    US sellers can purchase USPS postage on Yumm St. to fulfill their orders. Use of USPS postage is subject to applicable USPS rules.

    Sellers may request a refund for USPS postage within 10 days of creating a label, as long as the label has not been used to ship a package. USPS reviews refund requests, and Yumm St. will notify sellers once a request is approved or denied.

    When you use Yumm St. Shipping Labels, you can purchase parcel insurance to protect your shipments. Insurance is available through Shipsurance for USPS and FedEx shipping labels and through Canada Post for shipping labels purchased from Canada Post.

    3. Shipping Insurance

    You may purchase parcel insurance from Shipsurance Services, Inc. for packages that are shipped using USPS or FedEx shipping labels. If you choose to purchase insurance from Shipsurance, you agree to the Shipsurance Coverage Rules.

It’s an ecosystem where people of all backgrounds inspire each other and build relationships through making, selling, and buying unique goods. We want everyone on Yumm St. to feel safe, and fostering an inclusive environment is our priority. This policy explains the kind of behavior we prohibit on Yumm St. to make sure we all have a positive experience.

    This policy is a part of our Terms of Use. By using Yumm St., you’re agreeing to this policy and our Terms of Use.

    On Yumm St., you cannot discriminate based upon:

    Yumm St. Payments allows buyers and sellers to use various forms of payments on Yumm St.com, Yumm St. Payments users can pay with and accept payment by credit card, debit card, some bank transfer services, and PayPal. This policy explains all of your rights and obligations when using Yumm St. Payments.

    This policy is a part of our Terms of Use. By using Yumm St. Payments, you’re agreeing to this policy and our Terms of Use.

    This document (the Yumm St. Payments Policy or the “Policy,” for short) sets out your rights and responsibilities when you use Yumm St. Payments on Yumm St.’s services (we’ll refer to Yumm St.com and other services as our “Services”), so please read it carefully. By using Yumm St. Payments, you’re agreeing to the Policy.

    The Policy is a legally binding contract between you and Yumm St.

    The Yumm St. Payments Policy is also a part of our Terms of Use. By using any of our Services, you’re agreeing to the Terms of Use.

    3. Third-Party Services

    Yumm St. has engaged third-party service providers to perform many of the services related to payment processing, including card processing, currency exchange, identity verification, fraud analysis and regulatory compliance. Yumm St. partners with Worldpay, PayPal, Adyen, and other licensed payment processors to facilitate card payments and other payments and the disbursement of funds to sellers. The provider and processing time for your payment will vary based on the country in which you're located. If there are insufficient funds in your bank account when our provider processes the payment for your purchase, Yumm St. reserves the right to contact you directly and to seek payment.

    Yumm St. may share your personal or transactional information with those third-party service providers when it's necessary to process payments. By using a third-party service, you may also be subject to an agreement with the third-party. For example, PayPal is a third-party service provided by PayPal Holdings, Inc. and is subject to the PayPal User Agreement. If Yumm St. receives notice that your shop's content or activity violates a third party's service agreement, we may at our sole discretion take action against your account to comply with their policies. Such actions may include canceling a transaction, disabling listings from your shop, suspending your selling privileges, or removing certain payment methods.

    PayPal

    Yumm St. supports two versions of PayPal: integrated PayPal and standalone PayPal.

    Integrated PayPal. Integrated PayPal allows sellers to receive funds from PayPal purchases directly into their Yumm St. payment account, without the need to manage a separate PayPal account. This means that if a buyer pays with PayPal, the funds from the order will be credited to a seller's payment account along with the rest of the orders. The standard Yumm St. Payments Payment Processing Fee (described below) applies to orders that go through integrated PayPal; there is no additional PayPal fee.

    Standalone PayPal. For sellers accepting standalone PayPal, you will receive funds from PayPal purchases directly into your PayPal account. This payment method exists for sellers in countries that are not yet eligible for Yumm St. Payments and for sellers in certain countries who have opted to continue receiving funds into their standalone PayPal accounts. Sellers who accept standalone PayPal will continue to pay PayPal fees. Orders paid through standalone PayPal are not covered by Yumm St.’s Seller Protection Program. Please note, in certain circumstances where a seller accepts Yumm St. Payments and standalone PayPal, it may be necessary for Yumm St. to process some PayPal transactions through integrated PayPal. For example, if a buyer chooses to pay with an Yumm St. Gift Card or Yumm St. Credit and covers the remaining balance using PayPal, Yumm St. can only process the transaction through integrated PayPal. Similarly, if a buyer purchases items from multiple shops in a single transaction and chooses PayPal as the payment method, Yumm St. may have to process the transaction through integrated PayPal.

    4. Yumm St.’s Rights and Responsibilities

    Yumm St. Payments functionality may be made available, modified, or discontinued by us at any time without notice and is subject to the limitations in Yumm St.’s Terms of Use.

    As a security measure, we may impose transaction limits on buyers and sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

    Yumm St. may refuse service of Yumm St. Payments to anyone, for any reason, at any time.

    Yumm St. reserves the right to decline transactions that we believe to be high risk, fraudulent, or in violation of Yumm St.’s Terms of Use.

    In the event that a buyer does not make payment for the purchase of a legitimate item sold using Yumm St. Payments (e.g., where the buyer used a stolen or unauthorized credit card), Yumm St. may provide limited payment protection to the seller, in the interest of fairness.

    Yumm St. maintains records associated with transactions on Yumm St. Payments and does not pass any secure data, including credit card numbers or bank account information to any sellers. Sellers will only receive shipping information and limited buyer account information necessary to complete the order. Yumm St.’s Privacy Policy further explains how Yumm St. handles user information.

    Yumm St. will send you any relevant notices regarding your use of Yumm St. Payments in accordance with our Electronic Communications Policy.

    5. Seller Rights and Responsibilities

    A. Use of Yumm St. Payments. If you live in a country in which Yumm St. Payments is available, you are required to sign up for Yumm St. Payments, which will result in your shop accepting payment through authorized credit and debit card transactions, some bank transfer services, PayPal, Apple Pay, and Android Pay. For you to sign up for Yumm St. Payments and receive payment for transactions made through Yumm St. Payments, you must provide valid account information for a bank account in the United States. Without this information, Yumm St. cannot pay you. If you live in a country in which Yumm St. Payments is available and you do not provide Yumm St. with this information, Yumm St. may refuse you access to the Services until you do so.

    B. Payment Accounts. Yumm St. Payments is only available to sellers who register and are approved for a payment account. A payment account allows sellers to track payment amounts, refunds, and fees related to transactions. Sellers must provide accurate personal information as requested during registration, and are responsible for maintaining and updating that information as necessary. Sellers will not impersonate any person or use a name he or she is not legally authorized to use. Sellers authorize us, and authorized agents, to verify their information (including any updated information) by accessing public records and obtaining credit reports about the sellers in order to approve a payment account. Sellers also authorize Yumm St. to verify the sellers’ information from time to time while the sellers are using Yumm St. Payments. Yumm St. verifies sellers’ information in order to safeguard the integrity of the marketplace and reduce the risk of fraud, money laundering, terrorist financing, and the violation of trade sanctions.

    Payment accounts are only available to individuals who are eligible to be sellers on Yumm St.’s services and who have a valid credit or debit card on file with Yumm St., unless they are exempt from this requirement. Sellers who have bank accounts established in Austria, Germany, and the Netherlands are not required to have a credit card on file with Yumm St. to have a payment account.

    C. Disputes. Sellers agree to resolve any disputes directly with a buyer or with the assistance of the dispute management and refund tools available on Yumm St., and in accordance with our Seller Policy and Terms of Use. In the event that a dispute is escalated to Yumm St.’s Support Team, Yumm St. reserves the right to issue a refund to a buyer if a transaction is found to be in violation of Yumm St.’s Seller Policy and Terms of Use. In the event that a buyer submits a chargeback, Yumm St. will respond to the credit card networks on behalf of the seller involved in the transaction; the seller agrees to provide any requested information to us within five calendar days of the request. Yumm St. reserves the right to recoup funds associated with buyer chargebacks.

    D. Communications. We will inform sellers of each transaction, or of other information pertaining to Yumm St. Payments, using our standard communication procedures (detailed in our Electronic Communications Policy), including by email or through Yumm St.'s Conversations tool.

    E. Refunds. Refunds or adjustments paid by Yumm St. to buyers for payments made through Yumm St. Payments may be initiated using the refund functionality in the seller's payment account. Any such funds paid by Yumm St. to cover refunds will be deducted from the seller’s payment account balance. If there are insufficient funds to cover the amount of the refund, the balance will be charged to the seller’s credit card or added to the seller’s Yumm St. bill.

    Fully refunded transactions may be eligible for cancellation in accordance with the Seller Policy.

    F. International Trade Laws. You agree that your use of Yumm St. Payments will not involve any countries, entities, individuals or items prohibited by sanctions, embargoes, regulations or orders administered by the US Department of Treasury’s Office of Foreign Assets Control (“OFAC”) or other government agencies.

    6. Appointment of Yumm St. as Limited Collection Agent for Sellers

    Each seller appoints Yumm St. as its agent for the limited purpose of receiving, holding and settling payments to seller. Yumm St. will settle payments that are actually received by Yumm St. to each seller, less any amounts owed to Yumm St. and subject to these Terms. Each seller agrees that a buyer payment received by Yumm St., on behalf of seller, satisfies the buyer's obligations to make payment to seller, regardless of whether Yumm St. actually settles such payment to seller. If Yumm St. does not settle any such payments as described in these Terms to a seller, such seller will have recourse only against Yumm St. and not the buyer.

    7. Deposits

    A. Payment Account. All funds resulting from a completed transaction will be reflected as a balance in a seller’s payment account. Transactions are considered complete once the payment is approved by Yumm St. or our fraud analysis service provider. Any refunds, adjustments, or other amounts paid to buyers in connection with purchases, or for funds received since the last payment day, are also applied to the seller’s payment account balance. Funds in a payment account balance are eligible for deposit (the “Available Balance”) into a seller’s bank account at the end of any applicable deposit delay, reserve, or hold period as determined by the seller’s bank.

    B. Country and Currency Options. Available Balances can only be deposited into bank accounts, in the domestic currency of the account, in the United States.

    C. Scheduled Deposits. Yumm St. will instruct our payments partners to initiate a deposit of a seller’s Available Balance into the seller’s bank account on a daily, weekly, biweekly, or monthly basis. Sellers can select the frequency of disbursements from their payment account in their account settings. When a seller selects daily disbursements, disbursements will be made on each day that the seller's payment account has a balance equal to or greater than the minimum daily disbursement thresholds listed below. When a seller selects weekly, biweekly, or monthly disbursements, disbursements will be made on every applicable Monday. In this policy we'll refer to the date of disbursement as the "Payment Date". Deposits into a seller’s bank account will generally be credited within three (3) to five (5) business days from the date Yumm St. initiates the deposit request. The actual timing of the deposit may depend on how quickly a seller’s bank processes the request.

    Sellers may be charged for using some of Yumm St.’s services. This Fees & Payments Policy explains your fees, bills, and taxes and how to pay them.

    Sellers may be required to pay the following types of fees:

    Listing Fees

    You will be charged a listing fee of $0.20 USD for each item that you list for sale on Yumm St.com or Yumm St.'s mobile apps. There are no additional listing fees for listings that also appear on Yumm St.Studio.com. For items already listed on your Yumm St. shop, there are no additional listing fees to list items on your Pattern site. Listings that you only make available on your Pattern site do not incur a listing fee. You will only be charged a listing fee for creating or renewing a listing; there is no fee for editing a listing. You will be charged a listing fee whether or not the listed items sells, unless you create a private listing, in which case you will only be charged the listing fee when the private listing is sold. Yumm St.com and Yumm St. Studio listings expire after four months. Pattern-only listings do not expire. If you list multiple quantities of the same item, the initial listing fee will be $0.20, and the listing will be automatically renewed at $0.20 after each of the items sells. Listing fees will appear on your Yumm St. bill. It's important to note that listing fees are non-refundable.

    Transaction Fees

    When you make a sale through Yumm St.com, you will be charged a no transaction fee. If you sell from the US or Canada, the transaction fee will not apply to the shipping cost, sales tax, Goods and Services Tax, or Harmonized Sales Tax, unless you have included those charges in your listing price. If you sell from anywhere other than the US, the transaction fee will apply to the listing price (which should include any applicable taxes), but will not apply to the shipping cost. See the Taxes section below for more information about whether or not you are required to include applicable taxes in your listing prices. Transaction fees will appear on your Yumm St. bill.

    Payment Processing Fees

    Online Sales. Eligible Yumm St. shops may use Yumm St. Payments to accept certain payments through Yumm St. (learn more about Yumm St. Payments below). Yumm St. charges a payment processing fee for processing each transaction through Yumm St. Payments. Payment processing fees vary based on the location of your bank account. See the Yumm St. Payments Policy to find payment processing fees by country. This fee is assessed on the total amount of the sale, including tax and shipping. Unlike other fees, the payment processing fee is deducted from the transaction amount as the funds become available for deposit. Payment processing fees will be reflected in your payment account, rather than on your Yumm St. bill.

    Advertising Fees

    Yumm St. offers two forms of paid advertising: Promoted Listings and Google Shopping ads. If you advertise through Promoted Listings or Google Shopping ads, you will be charged separate advertising fees. Advertising fees vary by opportunity and will be clearly outlined before you commit to purchasing an ad. Advertising fees will appear on your Yumm St. bill.     Shipping Fees

    Yumm St. offers sellers based in the United States the ability to purchase shipping labels to fulfill their orders. The cost of the shipping label will be from the USPS, and the origin, destination, weight, and dimensions of the package. If you add signature confirmation or insurance, those fees will be added to the total cost of the label at the point of purchase. Sellers who purchase shipping labels may also purchase parcel insurance through licensed insurance carriers. You must accept Yumm St. Payments or PayPal as payment methods to purchase shipping labels through Yumm St. Shipping fees will appear on your Yumm St. bill.     . Wholesale Fees

    All sales made on Yumm St. Wholesale incur the standard transaction fee of 3.5% of the wholesale price (excluding taxes and shipping costs). Wholesale fees will appear on your Yumm St. bill. For more information, please see the Wholesale Seller Policy..

    2. Fee Avoidance

    Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by Yumm St. This includes, for example, encouraging buyers to purchase an item in your Yumm St. or Yumm St. Studio shop through another venue. A transaction initiated on Yumm St. may not be completed off of Yumm St. The price stated in each listing description must be an accurate representation of the sale. Sellers may not charge excessive shipping fees. Sellers may not alter the item's price after a sale for the purpose of avoiding Yumm St. transaction fees, misrepresent the item’s location, or use another user's account without permission.

    3. Paying your Yumm St. Bill

    Yumm St. will send you a bill at the beginning of each month. The Yumm St. bill will detail the amount due for the prior month’s fees and services. You are responsible for paying your Yumm St. bill in full within 15 days of the date of the invoice, or the account will be considered past due..

    Sellers may pay their Yumm St. bill manually by credit card, debit card, PayPal, or with their payment account balance. US sellers may also enroll in AutoBilling, Yumm St.’s automatic bill payment option. AutoBilling (US Sellers only).

    By enrolling in Yumm St.’s AutoBilling automatic payment plan, your fees will be charged to the credit card you have on file. To use the plan, you agree to the following terms.

    1. You authorize Yumm St. to keep your payment card information on file and to charge the card on file on the first day of each calendar month for the previous month’s outstanding charges and at any time the balance of fees reaches the designated fee threshold for your account. Upon enrollment, Yumm St. will charge the card on file with your current balance.
    2. When your card account is debited, Yumm St. will send you an email with the amount charged. You can also review this information by accessing your account on the Yumm St. site.
    3. If your card account on file with us is closed or the account number is changed, or if, for any reason, a charge is rejected by your card issuer, you must update your card information or add a new card number in your Yumm St. account. If your charge is refused by the issuer for any reason, you may be subject to penalties such as the suspension of your account privileges and/or termination, and you are not released from your obligation to pay your bill by some other means. Your authorization applies to any successor or replacement card you or your card issuer provides.
    4. You may cancel AutoBilling and change to manual billing by updating your billing setting in your Yumm St. account. Yumm St. requires a reasonable period of time to act after we receive your notice. This means that an additional automatic payment may be made to your card account while we are processing your request.
    5. Suspended or terminated members remain obligated to pay Yumm St. for all unpaid fees.

    Yumm St. Payments enables sellers to accept various forms of payment in their local currencies while using Yumm St.’s services. Sellers registered for Yumm St. Payments can accept payment by credit card, debit card, Yumm St. Gift Card and Yumm St. Credit, PayPal, some bank transfer services, Apple Pay, and Android Pay. Only Yumm St. Payments users in the US can use the Sell on Yumm St. Reader to accept in-person payments. Sellers using Yumm St. Payments are also subject to the Yumm St. Payments Policy.

    5. Taxes

    You are responsible for collecting and paying any taxes associated with using and making sales through Yumm St.’s services.

    If you sell physical goods on Yumm St. and reside in the US you have the option of either including applicable taxes in your listing prices, or excluding applicable taxes from your listing prices and then using our sales tax tool to calculate the tax owed on each sale. For items shipped to Washington State (or, for digital items, those purchased with a Washington state billing address), Yumm St. will use the category you assigned to the listing(s) to calculate, collect and remit the applicable sales tax. You are solely responsible for ensuring that all of your listings are properly categorized and you agree to indemnify Yumm St. for any losses it incurs in connection with any miscategorization of your listings by you.

    If you sell physical goods on Yumm St. and reside outside of the US you need to include all applicable taxes in your listing prices.

    Yumm St. will issue 1099-K forms to certain sellers in the United States to comply with IRS requirements.

    Seller Fees

    Handmade Policy

    Handmade on Yumm St. is a spectrum. On one end, we have makers-- sellers who are literally making their items with their own hands (or tools). On the other end, we have designers-- sellers who design their items, but rely entirely on production partners to help physically produce them. Many handmade sellers fall in the middle of the spectrum because they are both making and designing their items. Regardless of where you fall on this spectrum, you must be transparent about who is helping you and how your items are being made. You, the seller, must be making and/or designing your handmade items. Reselling is prohibited. Read more below about your obligations as a handmade seller.

    This policy is a part of our Terms of Use. By listing handmade items for sale through Yumm St., you’re agreeing to this policy and our Terms of Use.

    1. Selling Handmade Items

    Everything listed as handmade must be made and/or designed by you, the seller. You may also have shop members that help you run your business, as long as you, the seller, are making and/or designing your items. Please note that you do not need to identify solely as a maker or a designer; we imagine that many sellers are both. This is why we see handmade as a spectrum. Makers

    A maker is a seller who is physically making the items listed for sale in their Yumm St. shop. A maker might design their items in addition to making them, or they might follow a pattern or template that they did not design. Regardless, makers must be making their items with their own hands (or tools).

    Designers

    A designer is a seller who has come up with an original design, pattern, sketch, template, prototype, or plan to be produced by in-house shop members or a production partner. Simple customization, such as selecting colors, shapes, or choosing from ready-made options is not considered design on Yumm St.

    If you are a designer and you are using a production partner to help make your items, you must also follow our Manufacturing Policy and disclose information about your production partner in your listings.

    A production partner is anyone (who’s not a part of your Yumm St. shop) who helps you physically produce your items. We expect your production partner to produce items themselves, in their own facilities. A contractor or agent who outsources production is not considered a production partner. Examples of production services include, but are not limited to, printing, 3D-printing, casting, plating, engraving, cutting and sewing, and finishing.

    2. Being Transparent About Your Business

    At Yumm St., we value transparency. Transparency means that you honestly and accurately represent yourself, your items, and your business. You agree to:

  • Disclose in your About section the names and roles of people who help make your items or run your business;
  • Use your own words and photographs (not stock photos) to describe your items; and Respond to any inquiries from us in a timely manner. We may ask you how your items are made, what workspace, tools, and equipment you use; and how you communicate and collaborate with the people who help you run your shop.

    Remember: Our market is built on trust. Providing false, inaccurate, or misleading information is prohibited by our Terms of Use. We would hate to do it, but if we find that you’re not being open and honest with us, we may suspend or terminate your account.

      1. Using Production Assistance

      You may work with a production partner (also referred to as a “manufacturer”) to help produce handmade items you sell through Yumm St. (we’ll refer to Yumm St. and Yumm St. Studio collectively as “Yumm St.”). However, you must be a designer (as defined below and in our Handmade policy), and you must be transparent about your business, your production partner, and your design process, as further explained below. Keep in mind that people come to Yumm St. to discover items that they might not find anywhere else. Your design and production process should lead to the creation of a unique item that would not exist without you, the designer.

      A. Definitions

      A designer is a seller who has come up with an original design, pattern, sketch, template, prototype, or plan to be produced by in-house shop members or a production partner. Simple customization, such as selecting colors, shapes, or choosing from ready-made options, is not considered design on Yumm St.

      A production partner (or manufacturer) is anyone (who’s not a part of your Yumm St. shop) who helps you physically produce your items. We expect your production partner to produce your items themselves, in their own facilities. A contractor or agent who outsources production is not considered a production partner.       1. The name and/or descriptive title of your production partner(s);
    3. The location of your production partner(s);
    4. Details about the nature of your partnership and design process; and
    5. A general description of the work your production partner does for you.

    You may choose to keep the name of your production partner and details about your partnership and design process private (visible only to select Yumm St. admin), but the location and description of your production partner, as well as a general description of their work will appear on your About section and listings.

    We may reach out to you at any time with a more detailed inquiry about your business. Please be prepared to provide additional details about the origins of your business, your role in the design process, your production process, and your connection to your production partner, as well as what efforts your production partner has made to follow our ethical expectations.

    We understand that you may wish to keep the details of your design and business practices private. Please be assured that Yumm St. will not use the private information you provide us for any purpose other than reviewing your business to determine that you are in compliance with our policies.

    We reserve the right to reject any production partnerships that aren't in the letter or spirit of this policy, Yumm St.’s Handmade Policy, or our ethical expectations. We would hate to do it, but if we find that you’re not being open and honest or that your shop violates our policies or ethical expectations, we may suspend or terminate your account.

    Yumm St. is not a curated marketplace. However, for a variety of reasons, we prohibit certain types of items from the Yumm St. marketplace. Some items present legal risks to our community; others are inconsistent with our values, are harmful to our members, or simply are not in the spirit of Yumm St. This policy explains what is prohibited or restricted on Yumm St.

    This policy is a part of our Terms of Use. By opening an Yumm St. shop, you’re agreeing to this policy and our Terms of Use.

    The following types of items are prohibited or restricted on Yumm St.:

    1. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
    2. Animal Products and Human Remains

    Policy decisions are complex. We consider many different and often divergent factors before coming to a decision about what is best for our community. Because we are a creative community, we err on the side of freedom of expression. We also tend to allow items that have educational, historical, or artistic value, but we know that even those items are subject to a variety of valid and sometimes conflicting interpretations and emotional responses. Art and history can be provocative, emotional, and divisive. There are some topics on which we may never reach a consensus as a community, and that is okay. In the words of Joyce Carol Oates, “art should not be comforting; for comfort, we have mass entertainment and one another. Art should provoke, disturb, arouse our emotions, expand our sympathies in directions we may not anticipate and may not even wish.”

    In order to help provide clarity and insight into our policy making process, we have included the rationale behind our decisions and details about how they will be enforced, including some representative examples below of what is allowed on Yumm St.

    Strong id="alcohol">. Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs Alcohol and drugs are prohibited on Yumm St. These substances face serious legal restrictions and in many cases are considered controlled substances under applicable law. Our policy also applies to other substances that have or are claimed to have an intoxicating or healing effect. Possible legal restrictions aside, these substances simply are not in the spirit of Yumm St. and we therefore do not allow them. More Details: The following are examples of items that may not be sold on Yumm St.:

  • Alcohol.
  • Tobacco products, smokeable products, e-cigarettes, and e-liquid.
  • Drugs and certain herbal substances, including substances used for recreational and medicinal purposes, regardless of their legality.
  • Drug paraphernalia, including, for example: items with a carburetor; slides and/or items with a slide; bongs and bubblers; vaporizers and their components.
  • Medical drugs and pharmaceuticals.
  • Restrictions on descriptions of purported health benefits:

    A medical drug claim is any element of a listing or shop that suggests an item prevents, heals, or treats a medical condition or disease. Medical drug claims are subject to varying degrees of regulation. If you make claims about the purported health benefits of an item for sale on Yumm St., we urge you to speak with a qualified expert about which regulations apply to you. It is your responsibility to know and comply with all laws and regulations that apply to the items you sell.

    Yumm St. prohibits certain medical drug claims based on our values, such as claims likely to deceive or pose an unreasonable risk to our community. Yumm St. may remove claims that we deem to be inappropriate, excessive, or otherwise unsuitable for our marketplace. If Yumm St. receives proper notice from a legal authority, we may remove an item.     2. Animal Products and Human Remains

    Certain animal products are highly regulated and not in the spirit of Yumm St. due to the risk of harm to live, companion, or endangered animals.

    The following are examples of animal products that may not be sold on Yumm St.:

    1. Live animals.
    2. Items created using any animal species designated as threatened or endangered by the US Endangered Species Act or listed in Appendix I of the Convention on International Trade in Endangered Species (CITES). Click here for more information.
    3. Items made from cat and dog parts or pelts as defined by US Federal Law.
    4. Ivory or bones from ivory-producing animals, including tusks, elk ivory, fossilized ivory, and wooly mammoth ivory.
    5. Items made from human remains, except for teeth and hair.

If you are shipping items across international borders you should also consult CITES (the Convention on International Trade in Endangered Species of Wild Fauna and Flora) for specific information about importing and exporting items that may be threatened due to the nature of this trade.     3. Dangerous Items: Hazardous Materials, Recalled Items, and Weapons

    For safety reasons and due to complex legal regulations surrounding certain items, we ask that our members not sell items that could be considered dangerous.

    Due to the potential harm caused by hazardous materials, as well as complex legal regulations surrounding such materials, including shipping restrictions, hazardous materials are prohibited on Yumm St.

    While not exhaustive, the following materials are examples of prohibited hazardous materials:

    1. Explosives (fireworks or sparklers)
    2. Flammable items
    3. Gases
    4. Radioactive material
    5. Toxic substances (such as poisons)

    Recalled Items or Items that Present Unreasonable Risk of Harm

    Items that have been recalled by governments or manufacturers are prohibited from being sold on Yumm St. A few examples of items that have been recalled are certain vintage Corning Ware percolators, lawn darts, and drop side cribs.

    Items that present an unreasonable risk of harm are prohibited, even if they have not been the subject of a recall. This would include, for example, items that present a choking hazard. We generally rely on information from various government agencies to identify these items.

    Weapons
    Context matters when it comes to defining what is or is not a weapon. When in doubt, it’s safe to assume that we won’t allow any tool or instrument that is intended to be used as a weapon to inflict harm on a person. The following items are generally not allowed on Yumm St.:

    1. Guns, knives, or other blatant weapons.
    2. Imitation weapons that look real or are prohibited by US law

    4. Hate Items: Items that Promote, Support, or Glorify Hatred

    We want Yumm St. to be a community where people of all backgrounds, nationalities, religions, political affiliations, and even different types of artistic taste and humor feel welcome. Art is incredibly subjective, and what is offensive to one is not necessarily offensive to others.

    Yumm St. does not allow items or listings that promote, support or glorify hatred toward people or otherwise demean people based upon: race, ethnicity, national origin, religion, gender, gender identity, disability, or sexual orientation (collectively, “protected groups”) or items or content that promote organizations or people with such views.

    The following items are not allowed on Yumm St.:

    1. Items that support or commemorate current or historical hate groups, including propaganda or collectibles. Examples of hate groups include Nazi or Neo-Nazi groups, Ku Klux Klan (KKK) groups, white supremacist groups, misogynist groups, or groups that advocate an anti-gay, anti-immigrant, or Holocaust denial agenda.
    2. Items that contain racial slurs or derogatory terms in reference to protected groups. Items denouncing or mocking groups or historical figures that have a history of organized, targeted violence against protected groups

    5. Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items

    Illegal items and items that promote illegal activity, including counterfeit or stolen items, are generally not allowed on Yumm St. Neither are certain items that are subject to complex legal regulations or registration systems. Because Yumm St. is a global company, it’s important to abide by the laws of the markets in which you are selling. What is legal in one country may be illegal in another. All forms of illegal activity are strictly prohibited. In addition, listings may not facilitate or promote illegal acts through images or descriptions.

    Additionally, due to complex legal restrictions that vary by location, Yumm St. does not permit the sale of real estate or motor vehicles (for example: automobiles, motorcycles, boats, travel trailers, etc.).

    We require sellers to follow all applicable laws for the items they list. Examples of items which may be subject to regulation include Native American crafts, plants and seeds, and food products.

    6. Internationally Regulated Items

    Yumm St. provides a direct connection between buyers and sellers around the world. If you buy or sell an item from another country, or if you enter into a transaction with someone across international borders, you are responsible for complying with laws and regulations of the country of destination as well as your local laws.

    When buying and selling internationally, you should comply with your local laws and also be aware that other countries may have their own set of restrictions. You might be prohibited from exporting or importing certain items under laws and regulations of the country of destination. The item you buy or sell may be subject to import taxes, customs duties, fees, and/or other regulations imposed by the country of destination. When you use Yumm St.’s services, you are also responsible for complying with economic sanctions and trade restrictions, including those implemented by the Office of Foreign Assets Control ("OFAC") of the US Department of the Treasury. All Yumm St. members must comply with our Sanctions Policy, regardless of their location. Yumm St. reserves the right to request that sellers provide additional information, disclose an item's country of origin in a listing, or take other steps to meet compliance obligations.

    You should be aware that third-party payment processors, such as PayPal, may independently monitor transactions for sanctions compliance and may block some transactions as part of their own compliance programs. Yumm St. has no authority or control over the independent decision-making of these providers.

    7. Violent Items: Items that Promote, Support, or Glorify Violence

    We want Yumm St. to be a safe place for everyone. While violent content can be a legitimate part of historical, educational, or artistic expression, it should never be used to promote or glorify violent acts against others.

    We do not allow Items or listings that promote, support or glorify acts of violence or harm towards self or others, including credible threats of harm or violence towards self or others. The following items are not allowed on Yumm St.:

    1. 1. Items that glorify human suffering or tragedies, including items that commemorate or honor serial killers
    2. 2. Items that attempt to exploit natural disasters or human tragedies
    3. 3. Items that encourage, glorify, or celebrate acts of violence against individuals or groups
    4. 4. Items that encourage self-mutilation, starvation, or other self-harm

    We hope these guidelines are helpful, but we cannot catalog every permitted or prohibited item. We reserve the right to remove listings that we determine are not within the spirit of Yumm St. Such listings will be removed from the site, and the member's selling privileges may be suspended and/or terminated. If you see something on Yumm St. that appears to violate these rules, you can report it to us. At the bottom of a listing page, you can click Report this item to Yumm St. To report copyright or intellectual property infringement, please follow the instructions in Yumm St.'s Intellectual Property Policy.

    For all other reports, or for any questions, please contact Yumm St. Support. Both you and a First-Time Seller who receives a valid invitation from you will receive Listing Credits from Yumm St. after the First-Time Seller clicks the unique link from your invitation, opens an Yumm St. shop and lists an item for sale for the first time.

    Listing Credits may only be applied toward fees for listing new items or renewing previously listed items for sale on our website or mobile apps. Listing Credits may not be applied toward a purchase on our marketplace or any previously accrued fees due to Yumm St. Should you or the First-Time Seller use Listing Credits to list items that are prohibited by Yumm St., the items shall be subject to removal by Yumm St. at its sole discretion and the redeemed Listing Credits shall not be reinstated. Listing Credits do not expire, but they will be voided within an Yumm St. account in the event of that account’s closure for any reason.

    Credits are not transferable and may not be sold or exchanged for cash. If you or your friends do not comply with this policy, or do not follow the directions on the referral pages or valid invitations, you may not receive the applicable credits, and Yumm St. will not be liable for any such non-compliance. Invitations may expire.

    Electronic Communications Policy

    Yumm St. is required to provide you with certain information in writing. This Electronic Communications Policy describes how we’ll provide that information to you. This policy is a part of our Terms of Use. By using any of Yumm St.’s services, you’re agreeing to this policy and our Terms of Use.

    1. Information Yumm St. Will Send You

    Yumm St. will sometimes need to send you important messages about your use of Yumm St.’s website, mobile apps or other services (collectively, our “Services”). This policy covers all of those messages, including the terms, policies and user agreements applicable to your use of the Services, billing statements, transaction information, privacy disclosures, tax statements and other legal documents that will be provided to you electronically (collectively, the “Electronic Communications”).

    2. Communications Will Be Sent Electronically

    Under this policy, you give your consent for Yumm St. to provide you with the Electronic Communications (including all legal terms and legally-required disclosures) electronically. You also agree that your agreement with electronic terms and disclosures has the same legal effect as if you had signed an agreement on paper.     Yumm St. may provide you with Electronic Communications (a) by emailing them to you at the email address listed in your Yumm St. account, (b) by posting them on the Yumm St. website or mobile applications, or (c) by making them available via a website designated in an email notice to you.

    4. Technical Requirements to Receive Electronic Communications

    In order to receive Electronic Communications, you must have the following:
    • • A computer or mobile device;
    • • A connection to the Internet;
    • •An internet browser that supports 128 bit encryption, with cookies enabled;
    • •An active email address; and
    • • Sufficient electronic storage space on your computer's hard drive or other data storage unit and/or an installed printer to print disclosures.

    5. Withdrawing Consent for Electronic Communications

    You may withdraw your consent to receive Electronic Communications at any time by submitting a request to us at:

    In order for Yumm St. to send you paper copies, you must have a current mailing address on file in your Yumm St. account. Yumm St. reserves the right to charge you reasonable fees to cover the costs of sending you paper copies of Electronic Communications.

    6. Updating Your Contact Information

    To ensure that you receive Electronic Communications, you should make sure that the contact information in your Yumm St. account is accurate. Yumm St. is not responsible for your failure to receive Electronic Communications if you failed to update your contact information.
